These Terms and Conditions govern the use of TimeNest, the platform for managing appointments, bookings, and WhatsApp reminders available at timenest.app.
TimeNest is a service developed and operated by Eder Jahziel Calderilla Rodríguez, from Mexico. By creating an account or using the platform you accept these terms. If anything is unclear, write to us at contacto@timenest.app before using the service.
1. Acceptance and who may use TimeNest
By signing up, logging in, or using TimeNest you accept these terms and the Privacy Policy. If you use TimeNest on behalf of a business, you represent that you are authorized to bind that business.
- You must be at least 18 years old to create a business account.
- The information you register (name, business details, services, and prices) must be truthful and kept up to date.
- These terms apply to the entire business team: every member you invite becomes subject to them upon accepting the invitation.
People who only book an appointment on a business's public page do not need an account; their primary relationship is with the business they book with (see section 8).
2. What the service is (and is not)
TimeNest provides service businesses — barbershops, salons, studios, clinics, and the like — with an online schedule, a public booking page, and WhatsApp confirmations and reminders.
- TimeNest is a tool, not an intermediary for the services your business offers: we take no part in providing the booked service and we do not charge your clients for appointments.
- Prices shown on your booking page are for reference; payment for your services happens outside TimeNest, directly between your business and your client.
- Message delivery relies on the WhatsApp Business platform operated by Meta; TimeNest does not control that infrastructure (see section 5).
3. Your account and its security
- You are responsible for keeping your credentials confidential and for all activity under your account.
- You can sign in with email and password or with your Google account.
- Notify us immediately at our contact email if you detect unauthorized access.
- Roles and permissions within the business (owner, manager, professional) are managed by the owner; TimeNest enforces those permissions but does not decide who holds them.
4. Plans, payments, and cancellation
Plans
- TimeNest Free: free of charge, with the limits published on the pricing page (currently 1 location, up to 2 team members, and 50 WhatsApp messages per month).
- TimeNest Pro: a paid subscription in Mexican pesos (MXN), billed monthly or annually, at the current price published on timenest.app, with the limits described there (currently unlimited staff, up to unlimited branches, and 350 WhatsApp messages per month; additional messages are billed per usage).
Billing and renewal
- Pro payments are processed through Mercado Pago, under its terms and conditions. TimeNest does not store your full card details.
- The subscription renews automatically at the end of each billing period (month or year) until you cancel it.
- We may change plan prices or limits; any change will be announced with reasonable notice and will apply starting from your next billing cycle, never retroactively.
Cancellation and refunds
- You can cancel your subscription at any time from your account settings, with no lock-in periods or penalties.
- Upon cancellation, Pro remains active until the end of the paid cycle and no new charges are made. No prorated refunds are issued for partial periods.
- When the cycle ends, your account switches to TimeNest Free with its limits; your data is not deleted for changing plans.
5. WhatsApp messaging
- Confirmations and reminders are sent through Meta's WhatsApp Business platform. Availability, delivery, and timing depend on that platform and on the recipient's device; TimeNest does not guarantee delivery of every message.
- Each plan includes a monthly message allowance. When the limit is reached on Free, sending pauses until your next cycle; on Pro, additional messages are billed per usage.
- You agree to use messaging only for communications related to your business's appointments and in accordance with the WhatsApp Business policy. Using it for spam or unsolicited messages is grounds for suspension.
6. Acceptable use
By using TimeNest you agree NOT to:
- Use the platform for illegal activities or to offer services prohibited by applicable law.
- Impersonate another person or business, or register false information.
- Send unsolicited bulk messages or messages unrelated to your business's appointment operations.
- Attempt to breach the platform's security, access other businesses' data, or interfere with its operation.
- Resell or sublicense the service without our written authorization.
7. Your content and your data
- The content you upload (logo, images, descriptions, services, your clients' data) is yours or you hold the rights to use it, and you are responsible for it.
- You grant us a limited, non-exclusive license solely to host and display that content in order to operate the service (for example, showing your logo on your booking page).
- Regarding your clients' personal data, your business is the data controller and TimeNest acts as processor, as detailed in the Privacy Policy.
- You are responsible for obtaining, where applicable, your clients' consent to contact them via WhatsApp.
8. Relationship between your business and your clients
Appointments booked through TimeNest constitute a direct relationship between the business and its client. The business is solely responsible for providing the booked service, its prices, its quality, and resolving any claims from its clients. TimeNest is not a party to that relationship and is not liable for breaches by the business or by the person booking.
9. Intellectual property
TimeNest's software, design, brand, and logos are the property of its operator. These terms do not transfer any rights over them to you, except the limited right to use the platform while your account is active.
10. Availability and changes to the service
- We work to keep TimeNest continuously available, but the service is offered without a guarantee of uninterrupted availability: there may be maintenance, updates, or failures beyond our control.
- We may add, modify, or remove features. If a change substantially reduces what your plan includes, we will announce it with reasonable notice.
11. Limitation of liability
TimeNest is provided “as is” and “as available.” To the maximum extent permitted by applicable law:
- We are not liable for indirect damages, lost profits, or lost opportunities arising from the use of or inability to use the platform (for example, a missed appointment due to an undelivered reminder).
- Our total liability to your business is limited to the amount you paid TimeNest in the three months preceding the event giving rise to it.
- Nothing above limits liabilities that the law does not allow to be limited.
12. Suspension and termination
- You can stop using TimeNest and delete your account at any time; the data deletion process is described in the Privacy Policy.
- We may suspend or terminate accounts that breach these terms — in particular sections 5 and 6 — with notice to the account's email unless the law or the severity of the case requires immediate action.
- Sections that by their nature should survive (intellectual property, limitation of liability, governing law) remain in force after termination.
13. Changes to these terms
We may update these terms. We will publish the current version on this page with its update date and, if the change is substantial, we will communicate it through your account's contact channels with reasonable notice. Continuing to use TimeNest after the effective date implies acceptance of the updated terms.
14. Governing law
These terms are governed by the laws of the United Mexican States. Before resorting to any other venue, we ask that you try to resolve any dispute by writing to our contact email.
